9279 - Lands and Water - NATIONAL RESOURCE ACCESS REGULATOR

Jackson, Rose to the Minister for Aboriginal Affairs, Minister for the Arts, and Minister for Regional Youth representing the Minister for Lands and Water, and Minister for Hospitality and Racing

(1) In relation to the National Resource Access Regulator for the last financial year, 2021-22, could the Minister please advise:

(a) The number of current enforcement matters?

(b) The number of alleged breaches that resulted in further investigation?

(c) The number of alleged breaches that have not resulted in further investigation?

(d) The number of alleged breaches resulting in a decision to prosecute?

(e) The number of alleged breaches resulting in a decision not to proceed with prosecution?

Answer -
NATOINAL RESOURCE ACCESS REGULATOR

(1) 

(a) NRAR had 826 active investigations as at 30 June 2022.

(b) NRAR commenced 1210 investigations into alleged breaches between 1 July 2021 and 30 June 2022.

(c) 563 allegations were assessed as unable to be substantiated as a breach of the Water Management Act 2000 to the threshold required by law.

(d) NRAR commenced 4 prosecutions in the financial year 2021-22, bringing the total commenced since establishment to 34.

(e) NRAR had carriage of 1206 alleged breaches in the financial year 2021-22 that did not to proceed to prosecution.

During this period the following top-tier sanctions for breaches of water law were concluded:

In addition, 11 prosecutions remain before the courts.
