(1) Is there any regulation, legislation or requirements for approvals for a hospitality venue to utilise the services of topless waitstaff?

(a) Could you please provide information regarding what planning approvals might be required for a hospitality venue, with or without a liquor licence, to utilise the services of topless waitstaff?

(i) If the answer references publicly available material, could you please provide the URL and page number where the relevant information is located?

(b) Can local council implement control, policies or any other instrument to require Council approval before a hospitality venue, with or without a liquor licence, can utilise the services of topless waitstaff?

I am advised:

(1)(a)-(c) Hospitality venues generally require development consent in line with provisions of the applicable Local Environmental Plan. Planning approval is not required for an approved venue in relation to the attire worn by staff. This is not a matter that can be regulated by a planning instrument.
