252 - UNETHICAL BUILDERS

  1. (a) Are there any reports of unethical builders operating locally in the Hunter?
    (b) If so, how many have been reported?
  2. Has any immediate and long-term action been taken to prevent unethical building?
Answer -

I am advised that:

  1. Since 30 June 2010, based on an assessment by postcode, NSW Fair Trading has received 114 home building enquiries from consumers in the Hunter region, involving 97 different traders. Of these traders, nine were identified more than once.
  2. Fair Trading employs building investigators and inspectors across the State, including the Hunter region, to facilitate compliance with the Home Building Act 1989 (Act) and assist consumers to mediate disputes with licensed contractors. 
    Fair Trading has a number of enforcement options available to encourage and enforce compliance with the Act. For minor breaches, a formal warning may be sufficient. However, penalty infringement notices (that is, monetary penalties), rectification orders, licence cancellations or suspensions and public warnings may be issued for more serious breaches. Where a trader has a record of repeated breaches, legal proceedings may be commenced.
    Fair Trading also undertakes frequent compliance programs that target different areas of the State. The Hunter region has previously been involved in these programs and will be included in future compliance campaigns.
