4278 - ONLINE ABUSE REPORTING MECHANISMS

Hornery, Sonia to the Attorney General, and Minister for the Prevention of Domestic Violence

Considering the rise of online abuse and harassment during the COVID-19 lockdown, particularly towards girls and young women aged 15 to 25, what is being done to strengthen reporting mechanisms to ensure social media platforms are taking down comments and accounts once reported?

I am advised:

The regulation of social media is a matter for the Commonwealth Government.

The Commonwealth eSafety Commission is the Commonwealth Government agency responsible for keeping Australian citizens safe online. Among other things, the eSafety Commissioner's functions include administering a civil penalties scheme to assist with the removal of intimate images or videos from online platforms and facilitating the taking down of serious cyberbullying material targeting an Australian child.

Some forms of online abuse may also constitute intimate image offences under New South Wales law. Under the Crimes Act 1900 (NSW), it is an offence to record or distribute an intimate image without consent. Where a person is convicted of such an offence, a court may order them to remove or delete the offending image.
