Will the Government establish a specialised domestic violence court in order to address the domestic violence crisis?

(a) If not, why not?

Answer -

The preferred approach of the Government is to apply the practices of specialist courts to all courts across New South Wales rather than concentrating expertise and resources in select locations. This ensures that all victims in New South Wales have consistent access to services and courts that meet their needs.
This is in line with the 2011 strategic review by the Department of Justice of the Domestic Violence Intervention Court Model (DVICM) trials and the 2012 NSW Parliament Standing Committee on Social Issues report 'Domestic violence trends and issues in NSW', which recommended that the most successful aspects of the DVICM be applied to all New South Wales local courts.

The Government is implementing the NSW Domestic Violence Justice Strategy which includes strategies aimed at better supporting victims in the court process, improving judicial expertise in domestic violence matters and enhancing defendant accountability.

Furthermore, the Government introduced new laws from 1 June 2015 to provide greater support for domestic violence victims in court by enabling victims to give their evidence in chief through a recorded video or audio statement.
