6200 - AGED CARE FACILITIES

  1. How will the National Disability Insurance Scheme Act 2013 and the National Disability Insurance Scheme (NSW Enabling) Act 2013 apply to those with a disability living in aged care facilities like Wallsend Aged Care Facility?
  2. Will young people with a disability living in a state run aged care facility be unable to remain in this facility due to legislation removing care for those with a disability from State run services?
Answer -

I am advised:

(1) - (2) Under the Commonwealth's National Disability Insurance Scheme Act 2013 a person may become a participant of the National Disability Insurance Scheme when they meet certain criteria related to age, residence, disability and early intervention.

The National Disability Insurance Scheme (NSW Enabling) Act 2013 does not apply to people with disability residing in aged care facilities like Wallsend.

A young person under the age of 65 who has been admitted formally to a residential aged care facility following eligibility approval by an Aged Care Assessment Team will continue to have permanent tenure.
