1371 - PENALTIES FOR MAYORS AND COUNCILLORS

  1. Will the Minister be implementing proposed moves by the Division of Local Government to suspend the pay of misbehaving mayors and councillors for up to six months?
  2. If so, when will this measure be implemented?
Answer -

I provide the following details in response to your questions:

I am advised that under the Local Government Act 1993, the Pecuniary Interest and Disciplinary Tribunal currently has the power to suspend a councillor's right to be paid a fee for up to 6 months for misbehaviour.

The Division of Local Government is currently undertaking a review of the Model Code of Conduct for Local Councils in NSW and the misbehaviour provisions of the Act. I am advised that one of the proposals made in a position paper the Division has issued in relation to its review is to also confer on the Chief Executive the power to suspend a councillors' right to be paid a fee for up to 3 months for misbehaviour.

I am advised that, following public consultation on the position paper, the Division expects its review to be completed and a report prepared for my consideration by early 2012.
