I provide the following details in response to your questions:
I am advised that under the Local Government Act 1993, the Pecuniary
Interest and Disciplinary Tribunal currently has the power to suspend a
councillor's right to be paid a fee for up to 6 months for misbehaviour.
The Division of Local Government is currently undertaking a review of the
Model Code of Conduct for Local Councils in NSW and the misbehaviour provisions
of the Act. I am advised that one of the proposals made in a position paper the
Division has issued in relation to its review is to also confer on the Chief
Executive the power to suspend a councillors' right to be paid a fee for up to
3 months for misbehaviour.
I am advised that, following public consultation on the position paper, the
Division expects its review to be completed and a report prepared for my
consideration by early 2012.
