Answer -

The NSW Police Force has advised me:
- The fitting of aftermarket exhaust pipes or systems is permitted in NSW
providing the components comply with Schedule 2 of the Road Transport (Vehicle
Registration) Regulation 2007 and the Protection of the Environment Operations
(Noise Control) Regulation 2008.
- Highway Patrol police rely on their expertise to detect vehicles fitted
with illegal exhausts. Offensive noise emitted from illegal exhausts is
easily detected and is often the trigger for further examination of the
equipment by police.
If a defective exhaust is detected, police may
issue a defect notice for its repair and⁄or certification by a licensed
repairer, or an Environment Protection Authority (EPA) notice in cases where
the driver is to take the motor vehicle to the EPA to be assessed.
Infringements can also be issued to the offending driver for the
modifications.
