Reduce Fatalities and Serious Injuries on NSW Roads Now!

To the Speaker and Members of the Legislative Assembly, Barney Wakes-Miller was killed by a drunk driver on July 18th, 2020. The driver walked free. Every day, one person dies on NSW roads - a 23% increase from last year - while over 28 others are seriously injured daily. Road trauma costs NSW $9 billion annually and impacts over 253,000 people. We can make the reckless and willful neglect of human life inherent in dangerous driving socially unacceptable. Consider how attitudes have shifted on sexual and domestic violence and fatal coward-punch assaults. We need a profound change in our approach to road safety, driven by lawmakers, law enforcers, and the judiciary, supported by a holistic view of the road transport system and interactions between people, vehicles, and the environment. Current road crime laws are outdated, ineffective, and unfit for purpose (e.g., R vs. Whyte). Sentencing outcomes remain out of touch with the proportionality of crimes and rehabilitation programs fail to be effective. We ask the Legislative Assembly to call on the Government to request a new "Road Crimes Act", including: 1. New offences such as Vehicular Homicide. 2. Stricter penalties, including mandatory rehabilitation programs and disqualification. 3. Enhanced sentencing guidelines and victim impact considerations. 4. Improved investigative, prosecutorial, and public defence standards. 5. A new standard of Australian Fatality Reporting. 6. Dangerous Drivers Register. 7. Compulsory Driver Rehabilitation Programs, including mandatory alcohol interlocks. for all convicted offenders. 8. Victim Impact Panels for serious road offenders that reduce reoffending.
