To the Speaker and Members of the Legislative Assembly,
Mid Coast Council on 28 April 2021 resolved to alter the zoning of land located at 1 Sanderling Rd, Hawks Nest (Lot 1 DP 1234229) from RE1 Public Recreation to R3 Medium Density Residential.
Lot 1 is located at the inland base of the main dune structure that runs the length of the sea frontage on Bennetts Beach, Hawks Nest. Page 275 of the Council Report states, ‘review of the site contours from available LiDAR data shows ... Levels range from around 4.5 – 7.2 AHD, and the irregular and undulating landform is typical of a coastal dune system the site is part of, albeit at the rear of the frontal dune.’
This is an important environmental issue which was not addressed in the Council Report and this land is particularly unsuitable for urban release due to its physical location.
The proposed rezoning will provide for a possible 124 units. Council Papers 28 April 2021 show five separate buildings for the site at 4 storeys.
We request that the Minister for Planning, Industry and the Environment exercise his Ministerial discretion and pursuant to section 9.1 (2) of the Environment, Planning and Assessment Act 1973 direct Mid Coast Council to exercise it functions under Part 3 of the Environmental, Planning and Assessment Act to prepare a local environmental plan to rezone the land contained in Lot 1 DP 1234229 ,also identified as 1 Sanderling Road, Hawks Nest to Zone RE1 Public Recreation.
