To the Speaker and Members of the Legislative Assembly,
We the undersigned citizens of NSW request the Legislative Assembly consider and act on the following;
1. Iconic Sydney Harbour needs help.
2. In Berrys Bay, Snails Bay and throughout other bays and coves from Parramatta to Manly are unused vessels, failing jetties and piles polluting our Harbour.
3. The dolphin wharves and moorings in our bays are being used for the dumping of redundant, decaying vessels outside the original intended and/or approved purpose of those facilities.
4. In the Stannards Marine Pty Ltd v North Sydney Council [2022] NSWLEC 99 case, Chief Justice Preston stated, “protection of the natural assets of Sydney Harbour has precedence over all other interests”.
5. Transport for NSW the responsible agency has failed to satisfactorily respond to community concerns to address these concerns.
We ask the Legislative Assembly to call on the Government to take necessary action to ensure;
1. Sydney Harbour is cleared and kept clear of redundant, decaying vessels and failing structures.
2. An independent investigation is undertaken to determine whether NSW government agencies properly and fairly responded to community concerns regarding the management of moorings and 'orphaned' assets.
3. An independent environmental and visual impact assessment be properly conducted before permitting vessels to be moored in the bays and coves of Sydney Harbour.
4. The use of the dolphin wharves and moorings in the bays be strictly limited to their original intended and/or approved purpose and not for long-term mooring of vessels.
