(4) The Early Drug Diversion Initiative applies to people who were issued with a fine for a first or second eligible low-level drug offence. The Early Drug Diversion Initiative is not drug decriminalisation and it is still an offence to possess and use illicit drugs in NSW. Police retain discretion in all cases to charge a person and issue a notice to attend court.
