728 POLICE—STATEMENT PROCEDURES—Mr Breen to ask the Treasurer, Minister for State Development, and Vice-President of the Executive Council representing the Minister for Police—
      (1) Does the Minister recall providing me with information on 7 June 2000 to the effect that New South Wales police are entitled to refuse witnesses copies of their statements?

      (2) Can the Minister inform the House what public benefit flows from this practice, particularly in the light of a report in yesterday’s (23 November 2000) Daily Telegraph about the case of Lisa Van Woudenberg?

      (3) Is the Minister aware that Ms Van Woudenberg was interviewed about a particular incident 8 years after the event by Detectives Michael Bostock and Michael Lennon and that:


        (a) she was pressured into giving a statement,

        (b) she was refused a copy of the statement, and

        (c) she cannot recall what was said?


      (4) Is the Minister also aware that the testimony of Ms Van Woudenberg is now a critical issue in the investigation of the murder of Phil Dilworth and that the testimony may be tainted by the failure of the police to provide Ms Van Woudenberg with a copy of her statement?

        (5) (a) Has the practice of not providing witnesses their statements developed since the Wood Royal Commission?

        (b) Can the Minister indicate whether this practice is likely to continue?


      (6) Does the Minister agree that the practice is out of line with current moral, ethical, professional and community standards, and represents an opportunity for a miscarriage of justice as demonstrated by the case of Ms Van Woudenberg?

      (7) Will the Minister undertake to arrange for all witnesses who have made statements to the police since the Wood Royal Commission to be provided with copies of their statements?
