S.O.223 Bills - Council amendments to Assembly bills - consideration of Council amendments
223. The Order of the Day having been read, amendments made by the Council in an Assembly bill shall be considered in detail.

| 2008 Precedent | 1. During consideration of a Legislative Council amendment to a bill a point of order was taken that the terms of the amendment had not been provided to members of the Opposition prior to the question "That the Legislative Council amendment be agreed to" being proposed. The Speaker stated that the proceedings were appropriate and in accordance with standing and sessional orders and added that "It is up to each member to ensure that he or she is up to date with amendments that come from the other place through the appropriate processes". After seeking further advice the Speaker advised the House that the bill and the amendment were placed in the boxes approximately 2 hours and 45 minutes prior to the order of the day being read. | 1992 Precedent | Standing and sessional orders suspended to provide for an unlimited greivance debate in order to enable the Parliamentary Counsel to conclude the drafting of a number of amendments relating to a bill which was returned from the Legislative Council. Debate on amendments to the Bill was resumed and following consideration in Committee a Message was sent to Legislative Council agreeing to Council amendments Nos 1,3,4,5,6,7 and 10, disagreeing to Council amendments Nos 2, 8, and 9 and proposing further amendments to the bill, with reasons emphasising that the proposed amendments are not in derogation of the principles incorporated in the bill and that the Assembly does not desire its action be drawn into a precedent by either House. Council message reported that Council was not insisting on its amendments 2, 8 & 9 and agreeing to Assembly's further amendments Nos 1 to 12 for the reasons given by the Assembly and on the understanding that such agreement is not to be drawn into a precedent.
