6. Member moved an urgent motion concerning the tabling of certain documents relating to the Department of Sport and Recreation Capital Assistance Program Grants for the period 1992-3. Several amendments were moved concerning the period to be covered by the resolution. 11. Motion agreed to on 17 November 1994 ordering that certain papers relating to police numbers be laid before the House and made public without restricted access by noon on 21 November 1994. Motion moved on 22 November to suspend standing and sessional orders to allow the Minister to comply with the resolution of the House, by requiring only the provision of a certified list of numbers, not names, in respect of the information sought. The Speaker indicated that he was somewhat troubled by the motion as there was a clear conflict between the motion and the resolution of the House. He believed that a dangerous precedent would be set if the House were to accept the motion in its present form, and suggested that the motion be reworded to state, "That this House rescinds its direction under Standing Order 54 pursuant to resolution of 17 November", and then set out the details identified by the honourable member for Ashfield and the date by which the papers are to be produced. The motion, as amended, was agreed to on 23 November.

On 24 November the Minister advised the House that he had examined the documents required under the resolution and believed that the production of the documents would risk the security of the persons named. He therefore would not comply with the resolution, but would ask the member moving the motion to vary that part of the motion dealing with persons in high security areas. Motion agreed to on 30 November to allow the rescission of part of the resolution of 17 November 94 for certain police documents. The Minister then tabled the required documents.

1993 Precedent1. Motion ordering "Premier" to lay upon the Table all papers relating to the defamation action involving the Treasurer agreed to. The Minister for Health subsequently tabled the papers and files held by his department, the Attorney General's department and the Department of Community Services, to which a member asked that he assure the House that all documents being tabled were on behalf of the Premier. The Minister replied that he had despatched a copy of the tabled documents to ICAC for independent review. Point of order taken that the Minister should detail the terms of reference to ICAC, to which the Speaker replied that any member of the House was free to make a reference to ICAC in whatever terms that person wished.
